SMJ Motors – Returns Policy Terms & Conditions
By purchasing a vehicle from SMJ Motors, you agree to the following terms and conditions regarding returns and after-sale matters:
- Used Vehicle Sales: All vehicles sold by SMJ Motors are used and sold as seen, unless otherwise stated in writing.
- Inspection Encouraged: Buyers are encouraged to inspect and test-drive vehicles before purchase. Any known faults or issues will be disclosed prior to sale.
- Return Requests: Return requests must be made in writing within 30 days of purchase, in line with applicable consumer laws and must state clear reasons for return.
- Return Inspection: All returned vehicles will be subject to an inspection by our appointed garage to verify condition and mileage. SMJ Motors reserves the right to refuse a return or refund if the vehicle shows evidence of misuse, neglect, or deliberate damage occurring after the date of sale.
- Return Administration Fee: A return administration fee of £250 + VAT will be charged on all approved returns.
- Mileage Deduction: A charge of £0.80 per mile will be deducted from the refund for every mile driven after the date of sale.
- Vehicle Condition on Return: Vehicles must be returned in the same condition as at the point of sale. Any damage, wear, or modifications will incur additional charges.
- Vehicle Return: Customers are responsible for the return of any vehicle at their own cost.
- Proof of Fault: For mechanical issues, the customer must provide a written diagnostic report from a qualified, independent garage.
- Right to Repair or Replace: SMJ Motors reserves the right to repair or replace the vehicle before agreeing to a full return and refund, as per Consumer Rights Act 2015.
- Refund Processing: Approved refunds will be processed within 14 working days of final inspection and agreement. Any approved refund will be made using the original payment method where possible, or via bank transfer if necessary.
- Vehicle Delivery & Collection: Return transport arrangements are the responsibility of the customer unless otherwise agreed in writing.
- No Refund for Additional Items: Optional extras (warranties, service packages, etc.) are non-refundable unless the vehicle return is accepted due to a major fault.
- Non-Returnable Vehicles: Vehicles used for commercial purposes or those that have been significantly altered or damaged after sale are non-returnable.
- Part Exchange Returns: If a return involves a part exchange vehicle, that vehicle must still be in the condition it was originally provided, or its value will be deducted from any refund.
- Road Tax & Insurance: The customer remains responsible for road tax, insurance, and any fines or penalties incurred until the vehicle is returned and ownership transferred back to SMJ Motors.
- Non-Transferable: This returns policy applies only to the original purchaser and cannot be transferred to any third party.
Legal Compliance: This policy does not affect your statutory rights under the Consumer Rights Act 2015.
